Deed of Release for Payments to Employees

This deed of release can be used when an employer wants to make a payment to an employee in full and final settlement of all entitlements. This could be an ex-gratia payment made on termination.

Keep in mind that you can’t make any of an employee’s contractual or statutory entitlements conditional on them executing a deed of release. So things like annual leave, long service leave and payments in lieu of notice have to be paid regardless of whether an employee executes a deed. Therefore, it is best to use this deed for payments over and above what they are entitled to.
